Ben graduated from St. Louis Priory School in 1995. Ben went on to earn a bachelor's degree in philosophy, magna cum laude, from St. Louis University in 1999.

He then graduated from St. Louis University School of Law cum laude in 2003.

Following law school, Ben worked as an associate with Blackwell Sanders Peper Marin LLP. While working at Blackwell, Ben represented large and small companies in various litigation matters in state and federal courts. Among other things, Ben defended fraud claims, sexual harassment suits, all varieties of discrimination suits, unemployment insurance claims, ERISA actions, FMLA actions, workers compensation retaliation cases, wrongful discharge actions, and breach of contract cases. Ben also participated in labor arbitrations and mediations of employment disputes. At Blackwell, Ben provided employment law advice on a daily basis to Fortune 1000 companies, and frequently gave presentations on employment law to large industry groups. In September 2005, Blackwell presented Ben with an award for excellence in lawyering.

In December 2005, Ben joined his brother, Sean, to form the Westhoff Law Firm LLP. In February 2006, Peter Westhoff joined the firm as a principal. Since the formation of the firm, Ben has successfully represented clients in a variety of employment matters, including discrimination, retaliation, sexual harassment, breach of contract and wrongful discharge lawsuits in state and federal courts. Ben also represents clients in serious personal injury cases in Missouri and Illinois, including auto and truck accident cases, wrongful death actions, premises liability actions, worker's compensation claims, and product liability cases.
